These general conditions of sale (CGV) are agreed between Estoril Sports Goods, Lda, headquartered at Av. da República 3000 – Edifício Estoril Office, loja 7B,
2649-517 – Alcabideche, Cascais, Portugal, registered at the Commercial Registry Office of Cascais sob n° AP. 5/20220310 with the collective number 516864300 and hereinafter referred to as “Estoril Sports Goods, Lda” and persons wishing to make purchases through the Estoril Sports Goods, Lda website – paarbrand.com hereinafter referred to as “User”.
These conditions apply exclusively to non-traders natural persons, being understood as such any natural person who acts for purposes that do not belong to the scope of their professional activity.
The parties agree that purchases made through this website will be exclusively governed by this contract to the exclusion of any conditions previously available on the website.

1 – OBJECT

The purpose of these general sales conditions is to provide and define all necessary information to the user about the ordering, sale, payment and delivery of purchases made on the website.
These conditions regulate all the steps necessary to place the order.
These general conditions will not be applicable if, by the type of order, it is found that the User is not a final consumer as defined in paragraph c) of article 3 of Decree-Law No. 24/2014, of 14 of February.

2 – ORDER

The User can order products on the website, selecting them and adding them to the shopping cart.
To place the order, you must complete the requested information and choose the options available throughout the process (delivery method, address, email, payment method, as well as the NIF and the name that, for tax purposes, you want on the invoice).
When placing the order, it is equivalent to full and complete acceptance of the prices and description of the products available for sale, as well as the general conditions of sale, which will be the only ones applicable to the contract thus concluded.
When placing the order, the User accepts to receive the invoice electronically, pursuant to article 12, no. 1 of Decree-Law no.
Estoril Sports Goods, Lda will honor orders received online only up to the limit of available stocks, in the absence of availability of the Estoril Sports Goods, Lda undertakes to inform the User as soon as possible.
The data contained in the invoice are the sole responsibility of the User.
The validity of orders depends on the payment method. In the case of payment by ATM or transfer, if it is not confirmed after 48 hours, the order will be cancelled.

3 – DELIVERY

Estoril Sports Goods, Lda offers two delivery methods, which the User can choose when placing the order.
Shipping costs vary according to the delivery method selected by the User and may, at any time and without prior notice, be changed by Estoril Sports Goods, Lda. To find out the shipping costs of an order, the User must add the products he wants to buy to the shopping cart and choose the delivery method.
No deliveries are made to PO Boxes.
In each product, the foreseeable period, in working days, for dispatch of the same is presented. These deadlines are merely indicative.
Estoril Sports Goods, Lda will always make an effort to meet the estimated delivery deadlines but, in the event of difficulty in meeting the delivery deadlines, it will inform the User of this, providing him with the option to terminate the contract. By not activating this right, we assume that the User remains interested in the order and that he consents to delivery beyond the aforementioned period.
To track an order in progress, the User may check its status by following the tracking code sent by the carrier.

4 – PAYMENT AND ORDER VALIDATION

In accordance with paragraph j) of no. 1, article 4, of Decree-Law no. 24/2014. of February 14, amended by Law nº 47/2014, of July 28 and by Decree-Law nº 78/2018, of October 15, Estoril Sports Goods, Lda proposes to the User the following payment methods:
Paypal (Visa, Mastercard and Paypal)
In the case of payment by credit card, the debit will be made on the User’s card immediately after registering the order and verifying the data entered.

ATM

The generated ATM reference remains active for up to 48 hours, being deactivated after this period.

MBWAY

Payment through MBWAY remains active for up to 5 minutes, being deactivated after that period.

Payment by Transfer

The transfer will be made to the data sent after ordering.

Estoril Sports Goods, Lda will make every effort to ensure maximum confidentiality and security in the data transmitted over the internet.
In order for your order to be accepted and validated, payment must be made under the terms and deadlines set out in paragraph 2 of the present.
After confirmation of receipt of payment, and within a maximum period of forty-eight hours, an email will be sent to confirm the validation of the order. The email will be sent to the email address indicated by the User.

5 – PRICES

Prices must be understood in Euros, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.
If there is a change in the price lists of products for sale on this website, this situation will require an update of the advertised prices. If this situation occurs, it will not affect orders already registered.
The prices shown always correspond to the most up-to-date prices in force, however, they should only be considered valid while they are visible on the website on a refreshed page (cache or pages not refreshed may show prices that are no longer in effect). The displayed price is only guaranteed under these conditions and only after the order is duly registered and paid in accordance with the payment terms contained in these GVCs (Article 2(6) and Article 2(1)).

6 – DISCOUNTS

On the Estoril Sports Goods, Lda website there are several promotional price proposals, in the form of percentage discounts on the retail price, which can be seen on various products.
All promotions have a specific period of validity, which can be consulted on the website.
Promotional discounts represent a commitment during the announced period, but always on condition that the order is completed by the User, through the “checkout” and the respective payment, until the end of that period.
Saving a product in the “shopping basket” does not guarantee the price or discount.

7 – GUARANTEES

In the event of a manufacturing defect, the User has the rights provided for in Decree-Law no. , are subject to a two-year legal guarantee.

8 – Right of Free Resolution

Under the terms of Decree-Law no. 24/2014, of 14 February, the Customer has 14 days after receiving the products to proceed with the termination of the contract and the return of the same. This period of 14 days will be suspended during the duration of the State of Emergency.
To make a return, the User can do it directly through the CTT carrier. Alternatively, you can return it to an Estoril Sports Goods, Lda store, by contacting Estoril Sports Goods, Lda in advance via the email contacto@paarbrand.com
The product must be in perfect condition and must be returned, without signs of use, in its original packaging.
If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and shipping costs are reimbursed. The return expenses are borne by the User, if he/she intends to return the product(s) in a different and more expensive delivery method than the commonly accepted and less expensive method proposed by Estoril Sports Goods, Lda.
Exercising the right of free resolution, this must be done with the delivery of the annex contained in part B of Decree-Law No. 24/2014. of February 14, amended by Law No. 47/2014, of July 28, and by Decree-Law No. 78/2018, of October 15, in accordance with subparagraph l.
The refund will be made by the same means of payment used by the User in the initial transaction, unless expressly agreed to the contrary and without additional costs as a consequence of such refund.
Estoril Sports Goods, Lda, as long as the products are not received or as long as the User does not provide proof of their return, may withhold the refund.
In the case of a return, the refund of the amount will be made by bank transfer to the account indicated by the User.
Exclusion of the Right of Free Termination: There is no right to free termination of the contract in the following situations:
Supply of products which, by their nature, cannot be returned or are liable to deteriorate or quickly expire.

9 – Exchanges

If the value resulting from the exchange of products in an order is greater than the initial value of the same, the User will have to pay the difference.
If an exchange is made for a product of the same value, the User will not incur any additional cost.
Exchanges for products of lesser value are not allowed.
Items sent free of charge, in the form of a complement, gift or bonus, will not be refunded;
The rules established by DL 67/2003 of April 8th (Warranty regime for consumer goods) will apply to products purchased by the User within the scope of these GVCs, being considered consumer goods, with the necessary adaptations.

10 – COMPLAINTS

Estoril Sports Goods, Lda is not responsible for any inconvenience or damage caused to the User by the use of the Internet network, such as: service disruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.

The Parties agree that the computerized records, kept in the computer systems of Estoril Sports Goods, Lda under reasonable security conditions, prove the communications, orders and payments made between the parties.

14 – CONSERVATION AND ARCHIVE OF TRANSACTIONS

The file of orders and invoices will be made on a reliable and durable support to correspond to a faithful and lasting copy.

15 – APPLICABLE LAW AND COMPETENT JURISDICTION

The law applicable to any contractual relationship established through the Estoril Sports Goods, Lda. is Portuguese law.
